These Terms and Conditions govern access to and use of the Website, the platform and the NFC devices offered by Tapi NFC. Subscribing to the service implies full acceptance of these conditions.

1. Acceptance of the Terms

Use of the Website or the platform, or subscription to any Tapi NFC plan, implies full and unreserved acceptance of these Terms and Conditions in the version published at the time of access or subscription.

2. Description of the Service

Tapi NFC offers a software platform on a monthly subscription basis that enables businesses to:

  • View and manage Google Maps reviews.
  • Generate automatic replies to reviews using artificial intelligence.
  • Reply to reviews directly from the platform.
  • Manage the active NFC points associated with the account.

The service is provided for as long as the subscription is active and payments are up to date.

3. The NFC Devices

With certain subscription plans, Tapi NFC provides the customer with one or more physical NFC devices. These devices remain at all times the property of Tapi NFC and are lent to the customer for use (loan for use) for the duration of the active subscription.

Under no circumstances does the customer acquire ownership of the devices. Tapi NFC reserves the right to demand the return of the devices in the event of cancellation of the service or non-payment.

Additional devices subscribed to beyond those included in the base plan are managed under the same loan-for-use conditions, at an additional monthly cost set out on the pricing page.

4. Conditions of Use of the NFC Devices

Tapi NFC devices are made from materials specifically intended for indoor use under normal conditions. To ensure that they work properly and to preserve their integrity, the customer undertakes to comply with the following conditions:

Mandatory conditions of use

  • •Indoor use only. The devices are not designed for outdoor use or for direct exposure to the elements.
  • •Maximum exposure temperature: 45 °C. Do not place on hot surfaces, near cookers, ovens, radiators or braziers, on outdoor terraces in summer or in direct sunlight. Surfaces exposed to direct sunlight can exceed 70–80 °C and cause irreversible deformation of the device.
  • •Do not expose to moisture or liquids. The devices are not water-resistant.
  • •Do not bend or strike the device or tamper with its interior. Any physical alteration may permanently damage the NFC chip.
  • •Do not modify or repair the device yourself. In the event of any issue, contact Tapi NFC.

Wear and tear resulting from correct use under appropriate conditions is covered by the active subscription. Tapi NFC may consider replacing the device after verifying that the fault is not attributable to improper use.

5. Liability for Misuse

Tapi NFC shall not accept any liability for damage to or failure of the devices resulting directly or indirectly from non-compliance with the conditions of use described in the previous section, including but not limited to:

  • Deformation due to exposure to high temperatures or direct sunlight.
  • Damage due to moisture or contact with liquids.
  • Breakage or damage due to impacts or improper handling.
  • Use in unauthorised outdoor environments.

In such cases, the cost of replacing the device may be passed on to the customer.

6. How the NFC Link Works

The NFC link built into each device works through Tapi NFC's server infrastructure. When an end user scans the device, the request passes through Tapi NFC's servers, which manage and carry out the corresponding redirection.

This means that:

  • The proper functioning of the link depends on the availability of the Tapi NFC service.
  • If the subscription is suspended or cancelled for any reason, including non-payment, the NFC link will stop working immediately. End users who attempt to scan the device will not be redirected.
  • Tapi NFC is not responsible for the consequences of any interruption of the service for reasons attributable to the customer.

Reactivation of the link shall be subject to the subscription being brought up to date and the outstanding amounts being paid.

7. Prices, Payments and Suspension for Non-Payment

The applicable fees are published on the pricing page of the Website. The service is billed monthly in advance.

In the event of non-payment or failure to collect the monthly fee:

  • Access to the platform may be suspended.
  • The NFC links associated with the account will stop working.
  • Tapi NFC will attempt to notify the customer before proceeding with the suspension, although it is not obliged to do so in the case of repeated non-payment.

Tapi NFC reserves the right to change its prices with at least 30 days' prior notice, sent to the customer's email address.

8. Limitation of Liability

Tapi NFC shall not be liable for:

  • Technical failures beyond its control (network outages, incidents affecting third-party providers, etc.).
  • Improper use of the devices or the platform by the customer.
  • Loss of business, revenue or reputation arising from the interruption of the service.
  • Content generated by third parties through the platform.
  • Changes to the policies or operation of Google Maps or any external platform.

9. Intellectual Property

All content, software, branding, design and developments of the platform are the property of Tapi NFC or of their respective owners. Their reproduction, distribution or use without express authorisation is prohibited.

10. Amendments to the Terms

Tapi NFC may update these Terms and Conditions whenever necessary. Material changes will be notified to the customer with reasonable advance notice. The version in force will always be available on the Website.

11. Governing Law and Jurisdiction

The relationship between the customer and Tapi NFC shall be governed by Spanish law. For the resolution of any dispute, the parties submit to the courts and tribunals of Barcelona, unless the applicable legislation provides for a different jurisdiction.
